The aim of this one-day workshop is to introduce the principles of establishing and managing contractual relationships in a project environment.

Description
Professionals tend to concentrate on the technical aspects of their projects and as such, tend to spend less time and effort on the commercial and legal aspects of their projects. Most engineers though, often at an early stage in their career, will be in a position where they are required to either manage or administer a contract as a key part of a project for which they are responsible.

Contracts form the basis of most projects, where there is a supply of a product or service for a fee. It is the contract that stipulates the type of relationship between the parties involved, identifies and allocates the project risks between the parties, identifies the obligations and expectations of all involved, and dictates the manner in which the parties are to work together on the project. A well developed and managed contract is therefore a crucial component to ensuring the successful delivery of a project, where there is a supply of a product or service for a fee.

This workshop introduces you to the principles of establishing and managing contractual relationships, specifically in a project environment, to ensure successful project delivery. You will gain an awareness of legal and management issues governing contractual relationships in a wide scope of application areas.

This workshop qualifies for NZ Trade and Enterprise’s Capability Development Voucher Scheme.
Target Audience
This workshop is for managers, engineers, supervisors or anyone entering the field of contract management who needs a formal introduction to the concepts. It also serves as a refresher for experienced practitioners in contract and project management. As it is not focused to any particular sector or industry, it is applicable for anyone wishing to develop a more strategic, focused and managed approach to delivering contracts.

Contracting Process:


■The project life cycle - where contracts fit in the overall life cycle of performing work
■The contracting phase - preparing a contract and setting up the contractual relationship
■The tender process - a high-level overview of the process involved in calling for offers (tenders), their evaluation and allocation
■The contractual baseline/contract content - the key aspects that need to be contained in a contract
Introduction to Contract Law:


■Composition of an agreement - describing the difference between agreements and contracts
■Definitions - of key contract principles
■Contract criteria - the essentials of a contract in most jurisdictions
■Case studies to test knowledge of critical principles
■Elements of a contract - what to look for in a properly prepared contract
Tendering Process:


■Viewing the tender process in terms of offer and acceptance
■Developing a suitable 'Request for Proposal/Tender' - understand the consequences of a poorly developed document
■The tenderer's contract in New Zealand law
Managing Contracts:


■Contract management planning - what is needed to set up a contract and management process for effective management of contractual outcomes
■Managing the triple constraints of scope, budget and schedule (programme)
Variations:


■How to deal with changes to the contractual baseline
■Claims - justified and unjustified claims for extra payments against an originally agreed contractual scope
■Contract review - when and how to review and renegotiate aspects of a contract

Associate Professor Piet Beukman, FIPENZ, AFNZIM, has 35 years international experience in the field of engineering, technology management and commercialisation of technology, as well as training at university and industry level. He is highly regarded in New Zealand and internationally as a practitioner with a sound track record of achievement who uses a practical, but rigorous, approach.

Piet’s experiences are many and varied and include being the Chief Engineer of an airline, Systems Development Advisor to the South African Air Force, 20 years working in the South African defence, marine consulting engineering and aerospace industries, and Director of Technology Commercialisation at the University of South Australia. He was instrumental in the establishment of the Canterbury Innovation Incubator and Christchurch's Recovered Materials Foundation, taking the project from concept to being its founding CEO.

Piet is currently Director of the Master of Engineering Management programme and a former director of the Master of Business Administration (MBA) at the University of Canterbury. Piet mentors CEOs, consults with businesses and he also delivers training workshops.

He has presented numerous short courses and custom in-house workshops for local and international organisations including technology companies, district and city councils, electricity companies, infrastructure companies, government departments, and sports organisations.

Piet has developed a unique training style that combines underlying theory, practical examples and case studies into an integrated programme. He believes that learning should take place in a relaxed and friendly environment and that underlying principles should be taught first, before specifics, applications or tools are addressed.
